Terms

The terms for Timbrella and its subscription packages.

1. Who you are contracting with

Timbrella is operated by pageBody GmbH, Bahnstr. 12, 65205 Wiesbaden, Germany (Managing Director Ayhan Polat; Amtsgericht Wiesbaden HRB 33128; VAT DE350739802). These Terms govern your use of the app and your subscription. Full company details are in the Impressum. Questions: studio@timbrella.com.

2. What Timbrella does

Timbrella turns written content you supply into publish-ready episodes. For each episode it researches your topic, proposes angles, and produces an Episode Brief containing the angle, the researched facts with their sources, and the full script. You review and approve that Brief. Only then is the audio produced, together with a publishing kit of images and distribution details.

The service produces files; it does not publish them. Timbrella does not post to any platform on your behalf and holds no credentials for your channels. You download the episode and its kit, and you publish them yourself.

3. Packages, Credits, and what things cost

Timbrella is sold as a monthly or annual subscription. Each package includes a monthly allowance of Credits, which is the unit every generation step spends:

  • Starter, EUR 49 per month or EUR 490 per year, includes 50 Credits per month.
  • Studio, EUR 109 per month or EUR 1090 per year, includes 130 Credits per month.

An episode costs 15 Credits: 5 to research and plan it, and 10 to produce the audio and its kit. A revision of a Brief costs 1 Credit. Current costs are always shown in the app.

All prices are exclusive of VAT. VAT is added at checkout at the rate that applies to you, and the total is shown before you confirm. If you are a business in the EU outside Germany and enter a valid VAT identification number, the reverse-charge procedure applies and no VAT is added.

How the allowance behaves

  • Included Credits lapse at the end of each billing month. They do not roll over and they are not refundable in money.
  • You can buy extras (an additional episode production, an additional iteration) at the prices shown in the app. Extras stay valid for two months from purchase.
  • Credits have no cash value, cannot be transferred between accounts, and cannot be paid out.

4. Billing, renewal, and cancellation

Your subscription renews automatically at the end of each billing period, monthly or annually as chosen, until you cancel. Payment is taken at the start of each period by our payment processor.

You can cancel at any time from the billing area in the app. Cancellation takes effect at the end of the period you have already paid for; the service and the remaining allowance stay available until then, and you are not charged again. We do not refund part-used periods. You can switch between monthly and annual, or between packages, from the same place.

If a payment fails we may suspend generation until it succeeds. We may change prices with at least 30 days’ notice before the start of your next period; if you do not accept a change, you can cancel before it takes effect.

Deleting your account

Deleting your account is not the same as cancelling. Cancellation leaves the service running until the end of the period you have already paid for. Deletion takes effect as soon as we carry it out and cannot be undone: your subscription is cancelled, you are not charged again, and we do not refund the remainder of a paid period, or any extras you have bought and not yet used. What deletion erases, and the invoices we are legally required to keep afterwards, are described in our privacy notice. This paragraph does not affect your statutory rights under section 6.

5. Failed production

You are charged for work that is delivered. If a production fails on our side, retrying that episode does not cost you a further production charge.

6. Right of withdrawal

Timbrella is offered to businesses and other professional users, and the statutory right of withdrawal for distance contracts applies to consumers rather than to business customers.

Where you do contract as a consumer, you have the statutory right to withdraw within 14 days without giving a reason. Because the service is digital content supplied immediately, that right lapses once we have begun performing at your express request and you have acknowledged that you thereby lose it. In practice, performance begins the moment you start the first episode.

7. Your content, and what you get

What you put in stays yours. You keep all rights in the source content, brand material, and instructions you supply. You grant us only the licence needed to run the service for you: to process that material, send it to the providers named in the privacy notice, and generate your episodes.

What comes out is yours to use. Subject to your account being paid up, you may use the produced episodes, images, and publishing kit commercially, without restriction as to platform or territory. The synthetic voices remain licensed to us from our provider: you may publish the audio we produce, but you do not acquire any right in the voices themselves and may not extract or reuse them outside your episodes.

8. Your responsibilities when you publish

  • You confirm your standing on each topic. Every episode is produced under your attestation that the source content is yours, or that you have genuine expertise in the subject. Timbrella exists to amplify authority you can stand behind, and does not manufacture it.
  • You are the publisher. You review the Brief and the finished episode before publishing, and you are responsible for what you put out, including any platform rules, disclosure duties, and rights in material you supplied.
  • Keep the AI disclosure intact. Episodes are AI-generated. The publishing kit carries an AI disclosure line and the audio carries an AI Act marking. Do not remove them, and do not present the audio as a recording of a real person.
  • You may not use the service for unlawful, deceptive, or infringing content, to impersonate a real person, or to generate material about identifiable people that you have no right to publish.

9. Research, facts, and what we do not promise

Timbrella backs the claims an episode states as fact with evidence from a real fetch of the source, and drops the claim where it cannot. That is a meaningful check, not a guarantee of truth, and it does not apply to the directional research that shapes an angle. You review the Brief before anything is produced, and that review is part of the product, not a formality.

We do not promise any particular audience, ranking, reach, or commercial result. AI output can be wrong, and the service is provided without warranty that it will be uninterrupted or error-free.

10. Availability and changes to the service

We aim to keep the service available continuously but do not guarantee it. We may change or improve features, and we may retire a feature where it is no longer viable. If a change materially reduces what your package delivers, you may cancel as described above.

11. Liability

We are liable without limit for intent and gross negligence, and for injury to life, body, or health. For slight negligence we are liable only where an essential contractual obligation is breached, and then limited to the damage typical and foreseeable for this kind of contract. Liability under the German Product Liability Act is unaffected. Nothing in these Terms limits liability that cannot be limited by law.

12. Termination by us

We may suspend or terminate an account for serious or repeated breach of these Terms, for unlawful use, or where required by law. Where the breach can be cured we will say what is wrong and give you a chance to fix it first.

13. Applicable law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where you contract as a business, the place of jurisdiction is Wiesbaden, Germany. Where you contract as a consumer, the statutory rules on jurisdiction and the mandatory law of your country of residence are unaffected.

14. Changes to these Terms

We may update these Terms. Material changes are announced in the app at least 30 days before they take effect, and you may cancel before that date if you do not accept them.
